Hukuk Dairesi Karar\u0131<\/h3>\n<p>\u00d6zel Daire taraf\u0131ndan yap\u0131lan incelemede: \u201cDavac\u0131 i\u015f\u00e7inin sendika \u00fcyesi olmas\u0131 \u00fczerine toplu i\u015f s\u00f6zle\u015fmesinden yararlanmaya ba\u015flad\u0131\u011f\u0131 anda \u00fccretin d\u00fc\u015f\u00fcr\u00fcld\u00fc\u011f\u00fc iddias\u0131na dayal\u0131 olarak a\u00e7\u0131lan dava Dairemizin \u00f6nceki uygulamalar\u0131 ve kararlar\u0131 do\u011frultusunda karara ba\u011flanm\u0131\u015f olsa da Yarg\u0131tay 22. Hukuk Dairesi&#8217;nin kapat\u0131lmas\u0131 \u00fczerinde yeniden olu\u015fan Yarg\u0131tay 9. Hukuk Dairesi&#8217;nin Eyl\u00fcl 2020 tarihinde ald\u0131\u011f\u0131 ilke karar\u0131 do\u011frultusunda \u00fccretin d\u00fc\u015f\u00fcr\u00fcld\u00fc\u011f\u00fc iddias\u0131na ba\u011fl\u0131 taleplerin reddi gerekece\u011finden s\u00f6z\u00fc edilen redden dolay\u0131 daval\u0131 yarar\u0131na avukatl\u0131k \u00fccreti ve yarg\u0131lama giderine h\u00fckmedilmemelidir.&#8221; Denilmi\u015ftir.<\/p>\n<h3>\u0130lk Derece Mahkemesince Verilen Direnme Karar\u0131<\/h3>\n<p>\u0130lk derece mahkemesince bozma \u00fczerine yap\u0131lan yarg\u0131lamada: \u201cbenzer mahiyetteki bir uyu\u015fmazl\u0131kta Yarg\u0131tay Hukuk Genel Kurulunun 16.05.2018 tarihli ve 2015\/1429 Esas, 2018\/1089 Karar say\u0131l\u0131 karar\u0131n\u0131n da bozma \u00f6ncesinde verilen karar ile ayn\u0131 do\u011frultuda oldu\u011fu, yine benzer mahiyetteki ba\u015fka bir dosyada Yarg\u0131tay 9. Hukuk Dairesi taraf\u0131ndan verilen bozma karar\u0131n\u0131n oy \u00e7oklu\u011fuyla verildi\u011fi\u201d gerek\u00e7esiyle direnme karar\u0131 verilmi\u015ftir.<\/p>\n<p>Direnme Yoluyla Hukuk Genel Kurulu \u00d6n\u00fcne Gelen Uyu\u015fmazl\u0131k Hakk\u0131nda Genel Kurul Taraf\u0131ndan Yap\u0131lan \u0130ncelemede<\/p>\n<p>\u201cSonu\u00e7 olarak davac\u0131n\u0131n taraf sendikaya \u00fcye olup i\u015fyerinde uygulanmakta olan toplu i\u015f s\u00f6zle\u015fmesinden yararlanmaya ba\u015flad\u0131ktan sonra toplu i\u015f s\u00f6zle\u015fmesi h\u00fck\u00fcmleri kapsam\u0131nda g\u00fcnl\u00fck \u00fccretinde (yevmiyesinde) d\u00fc\u015f\u00fc\u015f olmu\u015f ise de, ak\u00e7al\u0131 menfaatlerinde bir b\u00fct\u00fcn olarak art\u0131\u015f meydana gelmi\u015f ve geliri y\u00fckselmi\u015ftir. Dolay\u0131s\u0131yla davac\u0131n\u0131n fark \u00fccret ve buna ba\u011fl\u0131 di\u011fer fark i\u015f\u00e7ilik alacaklar\u0131na hak kazanmayaca\u011f\u0131 kabul edilmelidir. H\u00e2l b\u00f6yle olunca, \u00d6zel Daire bozma karar\u0131na uyulmas\u0131 gerekirken \u00f6nceki kararda direnilmesi usul ve yasaya ayk\u0131r\u0131d\u0131r.\u201d denilmi\u015ftir.<\/p>\n<h3>Uygulanan Mevzuat<\/h3>\n<ol>\n<li>6356 say\u0131l\u0131 Kanun&#8217;un 36 nc\u0131 maddesi.<\/li>\n<li>M\u00fclga 2822 say\u0131l\u0131 Kanun&#8217;un 6&#8217;nc\u0131 maddesi.<\/li>\n<\/ol>\n<p><strong>Netice Olarak<\/strong><\/p>\n<p>\u0130lk derece mahkemesince verilen direnme karar\u0131nda gerek\u00e7e olarak \u201cbenzer mahiyetteki ba\u015fka bir dosyada Yarg\u0131tay 9. Hukuk Dairesi taraf\u0131ndan verilen bozma karar\u0131n\u0131n oy \u00e7oklu\u011fuyla verildi\u011fi\u201d ne dayan\u0131lm\u0131\u015ft\u0131r. Ancak belirtmek gerekir ki; Yarg\u0131tay 22. Hukuk Dairesi ve Yarg\u0131tay 9. Hukuk Dairesi\u2019 nin birle\u015fmesi sonras\u0131 konu ile ilgili olarak: \u201ci\u015f\u00e7inin i\u015f s\u00f6zle\u015fmesindeki temel \u00fccretinin sendikaya \u00fcye olmas\u0131 halinde azalmas\u0131 durumunda, mahkemece bir kar\u015f\u0131la\u015ft\u0131rma yap\u0131lmas\u0131 gerekti\u011fine; T\u0130S ile \u00f6ng\u00f6r\u00fclen \u00fccret ve ekleri ile sosyal haklar\u0131n i\u015f\u00e7i lehine olmas\u0131 halinde, i\u015f\u00e7inin k\u00f6k \u00fccretinin T\u0130S ile azalmas\u0131nda kanuna ayk\u0131r\u0131l\u0131k olmayaca\u011f\u0131na\u201d dair ilke karar\u0131 al\u0131nm\u0131\u015ft\u0131r.<\/p>\n<p>Hukuk Genel Kurulu\u2019nca yap\u0131lan de\u011ferlendirmede de s\u00f6z konusu ilke karar\u0131na uygun olacak \u015fekilde: \u201cDavac\u0131 i\u015f\u00e7inin sendikaya \u00fcye olup i\u015fyerinde uygulanmakta olan toplu i\u015f s\u00f6zle\u015fmesinden yararlanmaya ba\u015flad\u0131ktan sonra bordrolar\u0131nda saat \u00fccreti d\u00fc\u015f\u00fcr\u00fclm\u00fc\u015f ise de, \u00fccret tis ile d\u00fc\u015f\u00fcr\u00fcld\u00fc\u011f\u00fc i\u00e7in tek tarafl\u0131 i\u015fveren iradesiyle \u00fccretin d\u00fc\u015f\u00fcr\u00fclm\u00fc\u015f oldu\u011fundan s\u00f6z edilemeyece\u011fi, toplu i\u015f s\u00f6zle\u015fmesinde \u00f6ng\u00f6r\u00fclen yan \u00f6demelerle birlikte ak\u00e7al\u0131 menfaatlerinde bir b\u00fct\u00fcn olarak art\u0131\u015f meydana geldi\u011fi ve geliri y\u00fckseldi\u011fi i\u00e7in i\u015f\u00e7inin fark \u00fccret ve buna ba\u011fl\u0131 di\u011fer fark
