Kanun\u2019un 5. Maddesinin 4. f\u0131kras\u0131 uyar\u0131nca,\u00a0s\u00fcresinde y\u0131kt\u0131r\u0131lmad\u0131\u011f\u0131 tespit edilen riskli yap\u0131lar\u0131n y\u0131kt\u0131r\u0131lmas\u0131,\u00a0Bakanl\u0131k\u00e7a yaz\u0131l\u0131 olarak \u0130dareye bildirilecek, buna ra\u011fmen y\u0131kt\u0131r\u0131lmad\u0131\u011f\u0131 tespit edilen yap\u0131lar, Bakanl\u0131k\u00e7a y\u0131k\u0131lacak veya y\u0131kt\u0131r\u0131lacak; Bakanl\u0131k veya \u0130dare taraf\u0131ndan yap\u0131lan veya yapt\u0131r\u0131lan riskli yap\u0131 tespit, tahliye ve y\u0131kt\u0131rma masraflar\u0131, hisseleri oran\u0131nda maliklerden 6183 say\u0131l\u0131 Amme Alacaklar\u0131n\u0131n Tahsil Usul\u00fc Hakk\u0131nda Kanuna g\u00f6re tahsil edilecektir.<\/p>\n<h3>Riskli Yap\u0131n\u0131n Tahliyesi ve Y\u0131kt\u0131r\u0131lmas\u0131 Karar\u0131 Verilmesi Halinde Kiraya Verenin Kirac\u0131ya Kar\u015f\u0131 Sorumlulu\u011fu<\/h3>\n<p>6098 say\u0131l\u0131 T\u00fcrk Bor\u00e7lar Kanunu (\u201cTBK\u201d)\u2019nun 301. maddesi kiraya verenin asli borcu olan kiralanan\u0131 teslim borcunu d\u00fczenlemektedir. TBK m. 301 h\u00fckm\u00fc; \u201cKiraya Veren, kiralanan\u0131 kararla\u015ft\u0131r\u0131lan tarihte, s\u00f6zle\u015fmede ama\u00e7lanan kullan\u0131ma elveri\u015fli bir durumda teslim etmek ve s\u00f6zle\u015fme s\u00fcresince bu durumda bulundurmakla y\u00fck\u00fcml\u00fcd\u00fcr. Bu h\u00fck\u00fcm, konut ve \u00e7at\u0131l\u0131 i\u015fyeri kiralar\u0131nda Kirac\u0131 aleyhine de\u011fi\u015ftirilemez; di\u011fer kira s\u00f6zle\u015fmelerinde ise, Kirac\u0131 aleyhine genel i\u015flem ko\u015fullar\u0131 yoluyla bu h\u00fckme ayk\u0131r\u0131 d\u00fczenleme yap\u0131lamaz.\u201d \u015feklinde d\u00fczenlenmi\u015ftir. An\u0131lan h\u00fck\u00fcm kapsam\u0131nda, kiraya vereninin kiralanan\u0131, sadece teslim ederken de\u011fil; s\u00f6zle\u015fme s\u00fcresi boyunca da ama\u00e7lanan kullan\u0131ma elveri\u015fli durumda bulundurmas\u0131 gerekmektedir. Nitekim, kira s\u00f6zle\u015fmesi s\u00fcrekli edim borcu do\u011furan bir s\u00f6zle\u015fmedir<a href=\"https:\/\/lexist.com.tr\/tr\/?p=15749&amp;elementor-preview=15749&amp;ver=1685523950#sdfootnote1sym\" name=\"sdfootnote1anc\">1<\/a>.Doktrinde birtak\u0131m yazarlar taraf\u0131ndan deprem nedeniyle y\u0131k\u0131lan ya da a\u011f\u0131r hasar g\u00f6ren yap\u0131lara ili\u015fkin, kiralanan\u0131n yenilenmesinin a\u015f\u0131r\u0131 derecede masrafl\u0131 olmas\u0131 halinde, kiralanan\u0131n eski hale getirilmesi y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn\u00fcn kiraya verene y\u00fcklenemeyece\u011fi ve bu gibi durumlarda kira s\u00f6zle\u015fmesinin ekonomik imk\u00e2ns\u0131zl\u0131k nedeniyle sona erdi\u011finin kabul edilmesinin uygun olaca\u011f\u0131 savunulmaktad\u0131r<a href=\"https:\/\/lexist.com.tr\/tr\/?p=15749&amp;elementor-preview=15749&amp;ver=1685523950#sdfootnote2sym\" name=\"sdfootnote2anc\">2<\/a>.Yarg\u0131tay\u2019\u0131n yerle\u015fik i\u00e7tihatlar\u0131ndaysa; TBK\u2019n\u0131n 301. maddesi gere\u011fince,\u00a0kiraya verenin\u00a0kiralanan\u0131 s\u00f6zle\u015fmede ama\u00e7lanan kullan\u0131ma elveri\u015fli bir durumda teslim etmek ve s\u00f6zle\u015fme s\u00fcresince bu durumda bulundurmakla y\u00fck\u00fcml\u00fc oldu\u011fu, deprem halinde binan\u0131n y\u0131k\u0131lma riski bulundu\u011funun ispat edilmesi ya da kiralanan\u0131n s\u00f6zle\u015fmede \u00f6zg\u00fclenen amaca uygun olarak kullan\u0131lamaz hale gelmesi halinde bu durumunun kirac\u0131 i\u00e7in s\u00f6zle\u015fmenin hakl\u0131 nedenle fesih sebebi oldu\u011fu ve menfi zararlar\u0131n kiraya verenden tazmin edilebilece\u011fi y\u00f6n\u00fcnde h\u00fck\u00fcm kurulmaktad\u0131r:\u201c\u2026Mahkemece, bozmaya uyularak yap\u0131lan yarg\u0131lama sonucunda; kiralanan\u0131n i\u00e7inde oturulamayacak \u015fekilde\u00a0deprem\u00a0riski alt\u0131nda oldu\u011funun tespit edildi\u011fi, as\u0131l davada davac\u0131n\u0131n feshinin hakl\u0131 olmas\u0131 nedeniyle zorunlu giderlerinin toplam 42.590,09 TL oldu\u011fu; birle\u015fen davada, dava konusu binan\u0131n, riskli yap\u0131 olup, di\u011fer kirac\u0131lar taraf\u0131ndan da bo\u015falt\u0131ld\u0131\u011f\u0131 ve halen bo\u015f oldu\u011fu, ba\u015fka ki\u015filere kiraya verilmedi\u011fi, riskli binadaki hasar bedelinin kirac\u0131dan talep edilmesi m\u00fcmk\u00fcn olmad\u0131\u011f\u0131 gerek\u00e7esiyle; as\u0131l davan\u0131n k\u0131smen kabul\u00fcne, 42.590,09 TL &#8216;nin \u00f6deme tarihinden itibaren i\u015fleyecek yasal faizleri birlikte daval\u0131dan tahsili ile davac\u0131ya verilmesine, birle\u015fen davan\u0131n reddine karar verilmi\u015f; h\u00fck\u00fcm daval\u0131\/birle\u015fen dosya davac\u0131s\u0131 taraf\u0131ndan temyiz edilmi\u015ftir.1-) H\u00fckme esas al\u0131nan bilirki\u015fi raporunda, binan\u0131n, can g\u00fcvenli\u011fi a\u00e7\u0131s\u0131ndan y\u00fcksek risk te\u015fkil etti\u011fi,\u00a0deprem\u00a0g\u00fcvenlik d\u00fczeyinin yetersiz oldu\u011fu belirtilmi\u015f olup, mahkemece,\u00a0kirac\u0131lar\u0131n\u00a0feshinin hakl\u0131 oldu\u011fu y\u00f6n\u00fcndeki kab\u00fclde bir usuls\u00fczl\u00fck bulunmamaktad\u0131r. Bu durumda kirac\u0131lar, s\u00f6zle\u015fmenin feshi nedeniyle u\u011frad\u0131\u011f\u0131 menfi zarar\u0131 talep edebilecektir. Ancak davac\u0131lar\u0131n\u00a0tazminat\u00a0talebinin, yeni i\u015fyerinin bak\u0131m, onar\u0131m\u0131, ta\u015f\u0131nma ve yerle\u015fme ile ilgili harcamalar oldu\u011fu g\u00f6r\u00fclmektedir. Davac\u0131lar\u0131n kiralanandan ta\u015f\u0131nma masraflar\u0131 ve yeni kiralad\u0131klar\u0131 yer i\u00e7in yapt\u0131klar\u0131 tadilat, tamirat masraflar\u0131n, fesih nedeniyle u\u011fran\u0131lan zarar (menfi zarar) kapsam\u0131nda de\u011ferlendirilmesi ve talep edilmesi m\u00fcmk\u00fcn de\u011fildir\u2026\u201d (Yarg\u0131tay 3. Hukuk Dairesi, 2021\/7454 E., 2022\/4131 K., 26.04.2022 T.).\u201c\u2026TBK.nun 301. maddesi gere\u011fince\u00a0kiraya veren\u00a0kiralanan\u0131 s\u00f6zle\u015fmede ama\u00e7lanan kullan\u0131ma elveri\u015fli bir durumda teslim etmek ve s\u00f6zle\u015fme s\u00fcresince bu durumda bulundurmakla y\u00fck\u00fcml\u00fcd\u00fcr. Davaya konu kiralanan\u0131n bulundu\u011fu binan\u0131n\u00a0depreme\u00a0uygunluk raporunun bulunmad\u0131\u011f\u0131 a\u00e7\u0131kt\u0131r. Daval\u0131n\u0131n kiralanan kendi ta\u015f\u0131nmaz\u0131ndaki bu hukuki ay\u0131b\u0131 bilmesi ve kira s\u00f6zle\u015fmesi akdedilirken bu ay\u0131b\u0131 davac\u0131\u00a0kirac\u0131n\u0131n\u00a0bilgisine sunmu\u015f olmas\u0131 gerekir. Zira taraflar s\u00f6zle\u015fmenin kurulmas\u0131 s\u0131ras\u0131nda birbirine tam ve do\u011fru bilgi vermek zorundad\u0131rlar. Kiraya arz edilen bir yap\u0131n\u0131n yasal mevzuata uygun \u015fekilde al\u0131nm\u0131\u015f\u00a0depreme\u00a0dayan\u0131kl\u0131l\u0131k raporunun bulunmas\u0131 as\u0131l olup, yanl\u0131\u015f g\u00f6r\u00fcn\u00fcm vermek veya kiralanandaki kusur ve ay\u0131plar hakk\u0131nda bilgilendirme y\u00fck\u00fcml\u00fc\u011f\u00fcn\u00fc ihlal etmek s\u00f6zle\u015fmenin ihlali niteli\u011findedir. Bu nedenle feshin davac\u0131\u00a0kirac\u0131\u00a0y\u00f6n\u00fcnden hakl\u0131 gerek\u00e7eye dayand\u0131\u011f\u0131n\u0131n kabul\u00fc gerekir. Mahkemece davac\u0131n\u0131n taleplerinin, s\u00f6zle\u015fmenin hakl\u0131 nedenle feshi h\u00fck\u00fcmlerine g\u00f6re de\u011ferlendirilerek karar verilmesi gerekirken yaz\u0131l\u0131 gerek\u00e7e ile davan\u0131n reddine karar verilmesi do\u011fru de\u011fildir&#8230;\u201d (Yarg\u0131tay 6. Hukuk Dairesi, 2015\/3006 E., 2015\/5316 K., 02.06.2015 T.).\u201c\u2026Kural olarak kiralayan, ta\u015f\u0131nmaz\u0131 s\u00f6zle\u015fme ile ama\u00e7lanan kullan\u0131ma uygun bir halde teslim ve s\u00f6zle\u015fme s\u00fcresince bu halde bulundurmakla y\u00fck\u00fcml\u00fcd\u00fcr. Sat\u0131m akdi kira ili\u015fkisini kendili\u011finden ortadan kald\u0131ran bir sebep olmad\u0131\u011f\u0131ndan, kiralanan\u0131 sat\u0131n alan yeni malik de kiralanan\u0131 kullan\u0131ma uygun halde bulundurma borcu alt\u0131ndad\u0131r. Kiralayan\u0131n bu sorumlulu\u011fu ay\u0131ba kar\u015f\u0131 tekeff\u00fcl borcunu da i\u00e7ine al\u0131r. Di\u011fer bir anlat\u0131mla kiralayan s\u00f6zle\u015fme s\u00fcresince kiralananda meydana gelen bozukluklar\u0131 ve eksikleri\u00a0kirac\u0131n\u0131n\u00a0bir kusuru yoksa gidermekle y\u00fck\u00fcml\u00fcd\u00fcr. Sonradan ortaya \u00e7\u0131kan ay\u0131plar sebebiyle kiralanan\u0131n tamir ve bak\u0131m gereksinimi do\u011farsa\u00a0kirac\u0131\u00a0bozukluklar\u0131n \u00f6nemine ve niteli\u011fine g\u00f6re\u00a0kiraya verene\u00a0bu durumu bildirmek ve tamiri konusunda uygun bir s\u00fcre vermekle y\u00fck\u00fcml\u00fcd\u00fcr. Uyu\u015fmazl\u0131\u011f\u0131n \u00e7\u00f6z\u00fcmlenmesi taraflar aras\u0131ndaki s\u00f6zle\u015fmenin hakl\u0131 sebeple feshedilip edilmedi\u011fine ba\u011fl\u0131d\u0131r. Kiralanan\u0131n i\u00e7inde oturulamayacak \u015fekilde\u00a0deprem\u00a0riski alt\u0131nda oldu\u011fu tespit edildi\u011fi takdirde hakl\u0131 sebeple fesihten s\u00f6z edilebilecektir&#8230;\u201d (Yarg\u0131tay 6. Hukuk Dairesi, 2015\/7564 E., 2015\/11172 K., 17.12.2015 T.).Kirac\u0131, deprem riski nedeniyle kira s\u00f6zle\u015fmesini hakl\u0131 nedenle feshetmi\u015f olsa da kiralanan\u0131n anahtarlar\u0131n\u0131 kiraya verene usul\u00fcne uygun olarak (yaz\u0131l\u0131 belgeyle) teslim etme y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc devam etmektedir. Kirac\u0131, kiralanan\u0131n anahtarlar\u0131n\u0131 usul\u00fcne uygun olarak teslim etti\u011fini ispat edemezse; kiralanan\u0131n fiili olarak kiraya verenin tasarrufuna ge\u00e7ti\u011fi ispat edilinceye kadar kira bedeli \u00f6deme borcu devam edecektir. Yarg\u0131tay\u2019\u0131n kiralanan\u0131n anahtarlar\u0131n\u0131n usul\u00fcne uygun olarak teslim edildi\u011finin ya da kiralan\u0131n fiili olarak kiraya verenin tasarrufuna ge\u00e7ti\u011finin ispat edilmesine kadar kirac\u0131n\u0131n kira bedeli \u00f6deme borcunun devam etti\u011fine ili\u015fkin karar\u0131 \u015fu \u015fekildedir:\u201c\u2026Davac\u0131 taraf\u0131ndan 01\/12\/2015 tarihinde ba\u015flat\u0131lan icra takibi ile Aral\u0131k 2014, Ocak, \u015eubat, Mart, Nisan 2015 aylar\u0131, 333.502,47 TL kira alaca\u011f\u0131n\u0131n tahsili talep edilmi\u015ftir. Daval\u0131\u00a0kirac\u0131, kiralanan\u0131n 09\/03\/2015 tarihinde tahliye edildi\u011finin\u00a0kiraya verene\u00a0bildirildi\u011fini beyan etmi\u015ftir. Kiralanan\u0131n tahliye edildi\u011finin (kirac\u0131n\u0131n kiralanan\u0131 iade borcunu yerine getirdi\u011finin) kabul edilebilmesi i\u00e7in, kiralanan\u0131n fiilen bo\u015falt\u0131lmas\u0131 yeterli de\u011fildir. Anahtar\u0131n da\u00a0kiraya verene\u00a0teslim edilmesi gerekir.\u00a0Kirac\u0131\u00a0yasal tahliye ve anahtar teslimi ger\u00e7ekle\u015finceye dek kira paras\u0131n\u0131 \u00f6demekle y\u00fck\u00fcml\u00fcd\u00fcr. Kiralanan\u0131n anahtar\u0131n\u0131n usul\u00fcne uygun \u015fekilde\u00a0kiraya verene\u00a0teslim edildi\u011fini yaz\u0131l\u0131 delillerle kan\u0131tlama y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc daval\u0131 kirac\u0131ya aittir. Anahtar teslim edilmedi\u011fi s\u00fcrece kiralanan\u0131n\u00a0kirac\u0131n\u0131n\u00a0kullan\u0131m\u0131nda oldu\u011funun kabul\u00fc gerekir. Daval\u0131\u00a0kirac\u0131\u00a0anahtar teslimini yaz\u0131l\u0131 delille kan\u0131tlayamam\u0131\u015ft\u0131r ancak kiralanan\u0131n davac\u0131n\u0131n tasarrufunda oldu\u011funun tespiti durumunda, kiralanan\u0131n\u00a0kiraya veren\u00a0davac\u0131n\u0131n hakimiyetine ge\u00e7ti\u011fi bu tarihin tahliye tarihi olarak kabul\u00fc gerekmektedir. Davac\u0131\u00a0kiraya verenin, 18\/03\/2015 tarihinde, &#8230; 2.Asliye Hukuk Mahkemesi&#8217;nin 2015\/47 D.\u0130\u015f say\u0131l\u0131 dosyas\u0131nda tespit talebinde bulundu\u011fu, talep dilek\u00e7esinde,\u00a0kirac\u0131n\u0131n\u00a0anahtar\u0131 teslim etmeden 16\/03\/2015 ak\u015fam\u0131 kiralanandan \u00e7\u0131kt\u0131\u011f\u0131, kiralananda yap\u0131lan inceleme ve kontrollerde kiralanan\u0131n hasarl\u0131 oldu\u011funun belirlendi\u011fini belirtilerek\u00a0kirac\u0131\u00a0taraf\u0131ndan verildi\u011fi iddia edilen hasarlar ayr\u0131nt\u0131l\u0131 olarak beyan edilmi\u015ftir. Tespit talep dilek\u00e7esi de\u011ferlendirildi\u011finde, kiralanan\u0131n tespit talep tarihi olan 18\/03\/2015 tarihi itibariyle davac\u0131n\u0131n tasarrufuna ge\u00e7ti\u011finin kabul\u00fc gerekir. Bu durumda, Mahkemece,\u00a0kirac\u0131n\u0131n, tahliye tarihine kadar olan kira bedellerinden sorumlu oldu\u011fu g\u00f6zetilerek ve kiralanan\u0131n 18\/03\/2015 tarihinde tahliye edildi\u011fi kabul edilerek daval\u0131n\u0131n bu tarihe kadarki kira bedelinden sorumlu tutulmas\u0131 gerekirken yaz\u0131l\u0131 \u015fekilde karar verilmesi do\u011fru g\u00f6r\u00fclmemi\u015f, bozmay\u0131 gerektirmi\u015ftir\u2026\u201d (Yarg\u0131tay 3.
