Kiraya Verenin Hapis Hakk\u0131n\u0131n Konusu<\/h3>\n<p>T\u00fcrk Bor\u00e7lar Kanunu (TBK), ta\u015f\u0131nmaz bir mala ili\u015fkin olan kira s\u00f6zle\u015fmelerinde, kirac\u0131n\u0131n kiralanana getirdi\u011fi ta\u015f\u0131n\u0131r e\u015fya \u00fczerinde kiraya verene, kiraya verenin hapis hakk\u0131 olarak isimlendirilen kanuni rehin hakk\u0131 niteli\u011finde bir hapis hakk\u0131 tan\u0131m\u0131\u015ft\u0131r. T\u00fcrk Bor\u00e7lar Kanunu\u2019nun 336-338. maddeleri ile d\u00fczenlenen kiralayan\u0131n hapis hakk\u0131, T\u00fcrk Medeni Kanunu\u2019nun m. 395 vd. maddelerinde d\u00fczenlenen genel hapis hakk\u0131n\u0131n bir t\u00fcr\u00fc olarak kanundan do\u011fan bir rehin hakk\u0131d\u0131r<sup>1<\/sup>. Hapis hakk\u0131 ancak muaccel alacaklar \u00fczerinde kurulabilirken, kiraya verenin hapis hakk\u0131n\u0131 muaccel olmayan kira bedelleri \u00fczerinde de kullanmas\u0131 m\u00fcmk\u00fcnd\u00fcr. Ancak bu farkl\u0131l\u0131klara ra\u011fmen genel nitelikteki hapis hakk\u0131na ili\u015fkin kurallar\u0131n niteliklerine uygun d\u00fc\u015ft\u00fc\u011f\u00fc \u00f6l\u00e7\u00fcde kiraya verenin hapis hakk\u0131na uygulanaca\u011f\u0131 da kabul edilmektedir<sup>2<\/sup>. Ayr\u0131ca kira alaca\u011f\u0131n\u0131n teminat\u0131 olarak kiralayan lehine getirilen hapis hakk\u0131 \u0130cra \u0130flas Kanunu (\u0130\u0130K)\u2019nun 270-271. maddeleri uyar\u0131nca haczi kabil ta\u015f\u0131n\u0131r e\u015fya \u00fczerinde kullan\u0131labilir<sup>3<\/sup>. Bu hak sayesinde kiraya veren, belirli miktardaki kira bedeli alaca\u011f\u0131 \u00f6deninceye kadar s\u00f6z konusu e\u015fyay\u0131 al\u0131koyaca\u011f\u0131 gibi, alaca\u011f\u0131 \u00f6denmedi\u011fi takdirde paraya \u00e7evirme yoluyla alaca\u011f\u0131n\u0131n kar\u015f\u0131lanmas\u0131n\u0131 isteyebilecektir<sup>4<\/sup>.<\/p>\n<p>Yarg\u0131tay taraf\u0131ndan da hapis hakk\u0131 kanundan do\u011fan bir rehin hakk\u0131 olarak tan\u0131mlanm\u0131\u015f ve hapse konu mallar\u0131n \u00fc\u00e7\u00fcnc\u00fc bir ki\u015fi taraf\u0131ndan haczedilmesi ve mahcuzlar\u0131n paraya \u00e7evrilmesi halinde kiralayan\u0131n ge\u00e7mi\u015f bir y\u0131ll\u0131k ve i\u015flemekte olan alt\u0131 ayl\u0131k kira alaca\u011f\u0131n\u0131n sat\u0131\u015f bedelinden \u00f6ncelikle \u00f6denmesi gerekti\u011fi ifade edilmi\u015ftir:<\/p>\n<p><b>Yarg\u0131tay 23. Hukuk Dairesi, 2015\/243 E., 2015\/2172 K., 01.04.2015 T.<\/b><\/p>\n<blockquote>\n<p>\u201c<i>\u015eik\u00e2yet tarihi itibariyle y\u00fcr\u00fcrl\u00fckte bulunan TBK&#8217;n\u0131n\u00a0<\/i><a href=\"https:\/\/lib.kazanci.com.tr\/kho3\/ibb\/files\/tc6098.htm#336\" target=\"\u0130lgili maddeyi g\u00f6rmek i\u00e7in t\u0131klay\u0131n\u0131z\" rel=\"noopener\"><i>336<\/i><\/a><i>. (BK&#8217;n\u0131n 267.) maddesi uyar\u0131nca, kiralayan\u0131n i\u015flemi\u015f bir y\u0131ll\u0131k ve i\u015flemekte olan alt\u0131 ayl\u0131k\u00a0kira bedelinin\u00a0g\u00fcvencesi olmak \u00fczere kiralanan yerde bulunan kirac\u0131n\u0131n ta\u015f\u0131n\u0131rlar\u0131 \u00fczerinde\u00a0hapis hakk\u0131\u00a0bulunmaktad\u0131r. Kiralayan\u0131n\u00a0hapis hakk\u0131, kiralanan yerde bulanan kirac\u0131ya ait ta\u015f\u0131n\u0131r e\u015fyay\u0131 kira alaca\u011f\u0131na kar\u015f\u0131 al\u0131koymak ve kira borcunu \u00f6demedi\u011fi takdirde onu paraya \u00e7evirerek alaca\u011f\u0131n\u0131 \u00f6ncelikle tahsil etme yetkisi veren bir t\u00fcr kanuni rehin hakk\u0131d\u0131r. Ta\u015f\u0131n\u0131r mallar\u0131n kiralanan yere gelmesiyle i\u015fleyecek alt\u0131 ayl\u0131k kira sebebiyle\u00a0hapis hakk\u0131\u00a0do\u011far.\u00a0Hapis hakk\u0131\u00a0ta\u015f\u0131n\u0131r mallar\u0131n kiralanan yere gelmesiyle birlikte do\u011fdu\u011fundan daha sonra hapse konu mallar\u0131n \u00fc\u00e7\u00fcnc\u00fc bir ki\u015fi taraf\u0131ndan haczedilmesi ve mahcuzlar\u0131n paraya \u00e7evrilmesi halinde kiralayan\u0131n ge\u00e7mi\u015f bir y\u0131ll\u0131k ve i\u015flemekte olan alt\u0131 ayl\u0131k kira alaca\u011f\u0131n\u0131n sat\u0131\u015f bedelinden \u00f6ncelikle \u00f6denmesi gerekir. (Y.19.H.D. 18.3.1999 T., 1199 E., 1767 K. ve Y. 21.H.D. 29.11.2005 T., 6074 E., 12377 K. ve Dairemizin 16.12.2014 tarih ve 5154E., 8161 K. say\u0131l\u0131 ilamlar\u0131 bu y\u00f6ndedir.)\u201d<\/i><\/p>\n<\/blockquote>\n<p>S\u00f6z konusu hakk\u0131n konusu TBK m. 336 uyar\u0131nca kiralanan ta\u015f\u0131nmazda bulunan ve kiralanan\u0131n d\u00f6\u015fenmesine veya kullan\u0131lmas\u0131na yarayan ta\u015f\u0131n\u0131rlard\u0131r. Bu hususta \u00f6nemle belirtmek gerekir ki bu hak ta\u015f\u0131nmazda bulunan her t\u00fcrl\u00fc ta\u015f\u0131n\u0131r e\u015fyay\u0131 de\u011fil, yaln\u0131z ilgili ta\u015f\u0131nmaz\u0131n d\u00f6\u015fenmesine veya kullan\u0131lmas\u0131na yarayan ta\u015f\u0131n\u0131r\u0131 kapsar. Bununla birlikte TBK m. 336\/f.3 ve \u0130cra \u0130flas Kanunu m. 82 uyar\u0131nca hak yaln\u0131z haczi kabil mallar \u00fczerinde kullan\u0131labilecek olup kirac\u0131n\u0131n ki\u015fisel kullan\u0131m\u0131na \u00f6zg\u00fc e\u015fya \u00fczerinde kullan\u0131lamaz<sup>5<\/sup>.<\/p>\n<h3>II. Alt Kirac\u0131ya Ait E\u015fya \u00dczerinde Hapis Hakk\u0131<\/h3>\n<p>Kiraya verenin hapis hakk\u0131 alt kira ili\u015fkisi bak\u0131m\u0131ndan da uygulanabilen bir hakt\u0131r. Alt kira ili\u015fkisinde gerek genel kira s\u00f6zle\u015fmeleri ile konut ve \u00e7at\u0131l\u0131 i\u015f yeri kira s\u00f6zle\u015fmelerine ili\u015fkin gerekse de alt kira ili\u015fkisinin caiz olup olmad\u0131\u011f\u0131 ile ilgili bir ay\u0131r\u0131m yapmaks\u0131z\u0131n hak kullan\u0131labilecektir. Hakk\u0131n alt kirac\u0131ya kar\u015f\u0131 kullan\u0131labilmesi i\u00e7in alt kirac\u0131n\u0131n as\u0131l kirac\u0131ya kar\u015f\u0131 \u00f6denmemi\u015f kira borcunun bulunmas\u0131 gerekmektedir. Dolay\u0131s\u0131yla alt kirac\u0131n\u0131n as\u0131l kirac\u0131ya kar\u015f\u0131 \u00f6denmemi\u015f kira bedeli borcu bulunmuyorsa kiraya veren kiralananda bulunan alt kirac\u0131ya ait ta\u015f\u0131n\u0131rlar \u00fczerinde, as\u0131l kirac\u0131n\u0131n \u00f6denmemi\u015f kira bedeli borcu nedeniyle, hapis hakk\u0131n\u0131 kullanamayacakt\u0131r<sup>6<\/sup>.<\/p>\n<h3>III. \u00dc\u00e7\u00fcnc\u00fc Ki\u015fiye Ait E\u015fya \u00dczerinde Hapis Hakk\u0131<\/h3>\n<p>Kiraya verenin hapis hakk\u0131n\u0131n kiralananda bulunun \u00fc\u00e7\u00fcnc\u00fc ki\u015filere ait e\u015fyalarda uygulanmas\u0131 ise TBK m. 337\/f.2 uyar\u0131nca ancak kiraya verenin iyi niyetli oldu\u011fu durumlarda ge\u00e7erlidir. Bu kapsamda kiralanandaki e\u015fyalar\u0131n kirac\u0131ya ait oldu\u011funu bilmemeli ve bilmesi de gerekmemelidir. Kiraya verenin iyi niyetinin, \u00fc\u00e7\u00fcnc\u00fc ki\u015fiye ait e\u015fyan\u0131n ta\u015f\u0131nmaza getirildi\u011fi anda mevcut olmas\u0131 yeterlidir<sup>7<\/sup>. Kiralanan ta\u015f\u0131nmazda bulunan \u00fc\u00e7\u00fcnc\u00fc ki\u015fiye ait e\u015fya \u015fayet aleniyeti sa\u011flayan bir sicile tescil edilmi\u015fe bu halde kiraya verenin iyi niyetinden s\u00f6z edilemeyecektir.<\/p>\n<h3>IV. Hakk\u0131n Kapsam\u0131<\/h3>\n<p>Kiraya veren kirac\u0131s\u0131na kar\u015f\u0131 hapis hakk\u0131n\u0131 her t\u00fcrl\u00fc alaca\u011f\u0131 i\u00e7in de\u011fil yaln\u0131z kira bedeli alaca\u011f\u0131 i\u00e7in ve kanunda kira bedeli i\u00e7in \u00f6ng\u00f6r\u00fclen s\u00fcreler i\u00e7inde kullanabilecektir. Bu kapsamda TBK m. 336\/f.1 uyar\u0131nca kiraya veren hapis hakk\u0131n\u0131 i\u015flemi\u015f bir y\u0131ll\u0131k ve i\u015flemekte olan alt\u0131 ayl\u0131k kira bedelini g\u00fcvence alt\u0131na almak \u00fczere geriye ve ileriye y\u00f6nelik toplam on sekiz ayl\u0131k kira bedeli alaca\u011f\u0131 i\u00e7in kullanabilecektir<sup>8<\/sup>. Hakk\u0131n kapsad\u0131\u011f\u0131 s\u00fcrenin ba\u015flang\u0131c\u0131na ili\u015fkin her ne kadar TBK\u2019da bir d\u00fczenleme olmasa da \u00f6\u011fretide kabul edilen a\u011f\u0131rl\u0131kl\u0131 g\u00f6r\u00fc\u015fe g\u00f6re s\u00f6z konusu zaman diliminin ba\u015flang\u0131c\u0131 i\u00e7in kiraya veren taraf\u0131ndan, hapis hakk\u0131na ili\u015fkin olarak yap\u0131lan takip talebi tarihi esas al\u0131nmal\u0131, bu tarihten \u00f6nce gelen son kira bedeli \u00f6deme d\u00f6neminden geriye do\u011fru bir y\u0131ll\u0131k ve ileriye y\u00f6nelik alt\u0131 ayl\u0131k s\u00fcrenin hesaplanmas\u0131 buna g\u00f6re yap\u0131lmal\u0131d\u0131r<sup>9<\/sup>. \u0130\u015flemi\u015f bir y\u0131ll\u0131k ve i\u015fleyecek olan alt\u0131 ayl\u0131k kira bedelinin tespitinde ger\u00e7ekle\u015fen ve ger\u00e7ekle\u015fmesi gereken art\u0131\u015flar\u0131nda dikkate al\u0131nmas\u0131 gerekir<sup>10<\/sup>. Nitekim Yarg\u0131tay\u0131n emsal nitelikteki i\u00e7tihatlar\u0131 da bu y\u00f6ndedir:<\/p>\n<p><strong>Yarg\u0131tay 23. Hukuk Dairesi, 2014\/4772 E., 2015\/3997 K., 28.05.2015 T.<\/strong><\/p>\n<p><i>Kiraya verenin hapis hakk\u0131n\u0131 d\u00fczenleyen TBK&#8217;n\u0131n 336. (BK&#8217;n\u0131n 267.) maddesinde ise, &#8220;ta\u015f\u0131nmaz kiralar\u0131nda kiraya veren, i\u015flemi\u015f bir y\u0131ll\u0131k ve i\u015flemekte olan alt\u0131 ayl\u0131k kira bedelinin g\u00fcvencesi olmak \u00fczere, kiralananda bulunan ve kiralanan\u0131n d\u00f6\u015fenmesine veya kullan\u0131lmas\u0131na yarayan ta\u015f\u0131n\u0131rlar \u00fczerinde hapis hakk\u0131na sahiptir.&#8221; h\u00fckm\u00fcne yer verilmi\u015ftir. Kiralayan\u0131n hapis hakk\u0131, kiralanan yerde bulanan kirac\u0131ya ait ta\u015f\u0131n\u0131r e\u015fyay\u0131 kira alaca\u011f\u0131na kar\u015f\u0131 al\u0131koymak ve kira borcunu \u00f6demedi\u011fi takdirde onu paraya \u00e7evirerek alaca\u011f\u0131n\u0131 \u00f6ncelikle tahsil etme yetkisi veren bir t\u00fcr kanuni rehin hakk\u0131d\u0131r. Ta\u015f\u0131n\u0131r mallar\u0131n kiralanan yere gelmesiyle i\u015fleyecek alt\u0131 ayl\u0131k kira nedeniyle hapis hakk\u0131 do\u011far. Hapis hakk\u0131 ta\u015f\u0131n\u0131r mallar\u0131n kiralanan yere gelmesiyle birlikte do\u011fdu\u011fundan daha sonra hapse konu mallar\u0131n \u00fc\u00e7\u00fcnc\u00fc bir \u015fah\u0131s taraf\u0131ndan haczedilmesi ve mahcuzlar\u0131n paraya \u00e7evrilmesi halinde kiralayan\u0131n ge\u00e7mi\u015f bir y\u0131ll\u0131k ve i\u015flemekte olan alt\u0131 ayl\u0131k kira alaca\u011f\u0131n\u0131n sat\u0131\u015f bedelinden \u00f6ncelikle \u00f6denmesi gerekir.<\/i><\/p>\n<h3>V. Hapis Hakk\u0131n Kullan\u0131lmas\u0131<\/h3>\n<p>Kiraya verenin hapis hakk\u0131n\u0131 kullanabilmesi i\u00e7in kendisine kira borcu bulunan kirac\u0131n\u0131n, ta\u015f\u0131nmas\u0131 veya kiralananda bulunan ve hapis hakk\u0131na konu te\u015fkil edebilecek ta\u015f\u0131n\u0131rlar\u0131 ba\u015fka bir yere ta\u015f\u0131ma te\u015febb\u00fcs\u00fcnde bulunmas\u0131 gerekir. B\u00f6yle bir durumda kiraya veren TBK m. 338 uyar\u0131nca, kira bedeli alaca\u011f\u0131n\u0131n g\u00fcvence alt\u0131na al\u0131nmas\u0131na yetecek miktardaki ta\u015f\u0131n\u0131r e\u015fyan\u0131n al\u0131konulmas\u0131n\u0131 sulh hukuk mahkemesi veya icra dairesinden talep edebilecektir. Sulh hukuk hakimine veya icra dairesine ba\u015fvurman\u0131n zaman alaca\u011f\u0131 ve hapis hakk\u0131na tabi e\u015fyan\u0131n kiralanan ta\u015f\u0131nmazdan \u00e7\u0131kar\u0131lmas\u0131na derhal engel olunmas\u0131 gereken bir durumda, do\u011frudan m\u00fcracaat edilebilir<sup>11<\/sup>.<\/p>\n<p>Mahkeme veya do\u011frudan icra dairesi yoluna ba\u015fvurulmas\u0131 ve hakk\u0131n kullan\u0131lmas\u0131na y\u00f6nelik talebin yerinde bulunmas\u0131 durumunda, icra dairesi hapis hakk\u0131na tabi olan ta\u015f\u0131n\u0131rlar\u0131n bir defterini yapar. Deftere kaydedilen ta\u015f\u0131n\u0131r e\u015fya \u00fczerinde kirac\u0131n\u0131n tasarruf yetkisi s\u0131n\u0131rland\u0131r\u0131lm\u0131\u015f olur. Bir ba\u015fka anlat\u0131mla kirac\u0131, defterin yap\u0131lmas\u0131 ile art\u0131k belirli hale gelen hapis hakk\u0131na konu e\u015fyay\u0131, ta\u015f\u0131nmazdan uzakla\u015ft\u0131ramayacak, fakat paraya \u00e7evirme amac\u0131yla kendisinden al\u0131n\u0131ncaya kadar onlar\u0131 kullanmaya devam edebilecektir<sup>12<\/sup>.<\/p>\n<h3>VI. Kiralanandan Gizlice veya Zorla G\u00f6t\u00fcr\u00fclen E\u015fyan\u0131n Geri Getirilmesi<\/h3>\n<p>TBK m. 338\/f.2 ise al\u0131koyma karar\u0131na konu olan ta\u015f\u0131n\u0131r e\u015fyan\u0131n kiralanandan gizlice ya da zorla g\u00f6t\u00fcr\u00fclmesi halinde, g\u00f6t\u00fcr\u00fclmelerinden itibaren on g\u00fcn i\u00e7erisinde kolluk g\u00fcc\u00fcn\u00fcn yard\u0131m\u0131yla kiralanana geri getirilebilece\u011fi d\u00fczenlenmi\u015ftir. Benzer bir h\u00fck\u00fcm \u0130\u0130K m. 271\u2019de de yer almaktad\u0131r. Bu konuda \u00f6nemli olan husus, kiraya verenin on g\u00fcnl\u00fck s\u00fcre i\u00e7erisinde talepte bulunmu\u015f olmas\u0131 ve talebinin de gecikmesinde sak\u0131nca bulunan haller d\u0131\u015f\u0131nda, icra dairesine yap\u0131lm\u0131\u015f olmas\u0131 gere\u011fidir<sup>13<\/sup>.<\/p>\n<p><b>VII. Sonu\u00e7<\/b><\/p>\n<p>Kiraya verenin hapis hakk\u0131, ta\u015f\u0131nmaz bir mala ili\u015fkin olan kira s\u00f6zle\u015fmelerinde, kirac\u0131n\u0131n kiralanana getirdi\u011fi ta\u015f\u0131n\u0131r e\u015fya \u00fczerinde kiraya verene tan\u0131nan kanuni rehin hakk\u0131 niteli\u011finde bir hakt\u0131r. Bu hak sayesinde kiraya veren, belirli miktardaki kira bedeli alaca\u011f\u0131 \u00f6deninceye kadar s\u00f6z konusu e\u015fyay\u0131 al\u0131koyaca\u011f\u0131 gibi, alaca\u011f\u0131 \u00f6denmedi\u011fi takdirde paraya \u00e7evirme yoluyla alaca\u011f\u0131n\u0131n kar\u015f\u0131lanmas\u0131n\u0131 isteyebilecektir. Bu hak ta\u015f\u0131nmazda bulunan her t\u00fcrl\u00fc ta\u015f\u0131n\u0131r e\u015fyay\u0131 de\u011fil, yaln\u0131z ilgili ta\u015f\u0131nmaz\u0131n d\u00f6\u015fenmesine veya kullan\u0131lmas\u0131na yarayan ve haczi kabil ta\u015f\u0131n\u0131r e\u015fyay\u0131 kapsar. Hak ta\u015f\u0131nmazda bulunan alt kirac\u0131ya kar\u015f\u0131 da kullan\u0131labilecek olup hakk\u0131n alt kirac\u0131ya kar\u015f\u0131 kullan\u0131labilmesi i\u00e7in alt kirac\u0131n\u0131n as\u0131l kirac\u0131ya kar\u015f\u0131 \u00f6denmemi\u015f kira borcunun bulunmas\u0131 gerekmektedir. Hakk\u0131n ta\u015f\u0131nmazda e\u015fyas\u0131 bulunan \u00fc\u00e7\u00fcnc\u00fc ki\u015filere kar\u015f\u0131 kullan\u0131m\u0131 ise ancak kiraya verenin iyi niyetli oldu\u011fu hallerde m\u00fcmk\u00fcn olabilecektir.<\/p>\n<p>TBK m. 336\/f.1 h\u00fckm\u00fc uyar\u0131nca, kiraya veren, hapis hakk\u0131n\u0131 i\u015flemi\u015f bir y\u0131ll\u0131k ve i\u015flemekte olan alt\u0131 ayl\u0131k kira bedelini g\u00fcvence alt\u0131na almak \u00fczere geriye ve ileriye y\u00f6nelik toplam on sekiz ayl\u0131k kira bedeli alaca\u011f\u0131 i\u00e7in kullanabilecektir.
