Kirac\u0131, s\u00f6zle\u015fmenin feshini bildirmedi\u011fi s\u00fcrece s\u00f6zle\u015fme, s\u00fcre sonunu takip eden her y\u0131l i\u00e7in bir y\u0131l daha uzamaktad\u0131r. Kira s\u00f6zle\u015fmesi s\u00fcresinin kanun gere\u011fi uzamas\u0131na kar\u015f\u0131n, kirac\u0131 tahliye taahh\u00fcd\u00fc ile kira konusu ta\u015f\u0131nmaz\u0131 tahliye etme (bo\u015faltma) taahh\u00fcd\u00fcnde bulunabilir. Yaz\u0131l\u0131 tahliye taahh\u00fctnamesi, kirac\u0131n\u0131n belirli bir tarihte kiralanan\u0131 bo\u015faltmas\u0131n\u0131 taahh\u00fct eden ikale nevinden bir s\u00f6zle\u015fmedir.[1]<\/p>\n<p>Kira ili\u015fkisinin kirac\u0131dan kaynaklanan sona erme hallerinden biri olan, yaz\u0131l\u0131 tahliye taahh\u00fcd\u00fc sebebiyle sona erme hali; 6098 say\u0131l\u0131 T\u00fcrk Bor\u00e7lar Kanunu\u2019nun 352. maddesinin 1. f\u0131kras\u0131nda \u201cKirac\u0131, kiralanan\u0131n teslim edilmesinden sonra, kiraya verene kar\u015f\u0131, kiralanan\u0131 belli bir tarihte bo\u015faltmay\u0131 yaz\u0131l\u0131 olarak \u00fcstlendi\u011fi h\u00e2lde bo\u015faltmam\u0131\u015fsa kiraya veren, kira s\u00f6zle\u015fmesini bu tarihten ba\u015flayarak bir ay i\u00e7inde icraya ba\u015fvurmak veya dava a\u00e7mak suretiyle sona erdirebilir.\u201d \u015feklinde d\u00fczenlenmi\u015ftir.<\/p>\n<p>Tahliye Taahh\u00fcd\u00fcn\u00fcn \u015eartlar\u0131<br \/>\n6098 say\u0131l\u0131 T\u00fcrk Bor\u00e7lar Kanunu madde 352\/1\u2019den hareketle ge\u00e7erli bir tahliye taahh\u00fcd\u00fcnden bahsedebilmek i\u00e7in taahh\u00fcd\u00fcn yaz\u0131l\u0131 olmas\u0131, tahliye tarihinin a\u00e7\u0131k ve belirli \u015fekilde yer almas\u0131 ve kiralanan\u0131n tesliminden sonra verilmesi gerekmektedir.<\/p>\n<p>a. Tahliye Taahh\u00fcd\u00fcn\u00fcn Verilmesi<\/p>\n<p>Tahliye taahh\u00fcd\u00fc bizzat kirac\u0131 taraf\u0131ndan verilmelidir. Birden fazla kirac\u0131 olmas\u0131 halinde kirac\u0131lar aras\u0131nda mecburi dava arkada\u015fl\u0131\u011f\u0131 bulundu\u011fundan[2] ve kiralanan\u0131 bo\u015faltma borcu b\u00f6l\u00fcnebilir neviden bor\u00e7 olmad\u0131\u011f\u0131ndan, taahh\u00fcd\u00fcn t\u00fcm kirac\u0131lar taraf\u0131ndan birlikte verilmesi gerekmektedir.<\/p>\n<p>Tahliye taahh\u00fcd\u00fc ayr\u0131 bir beyan olarak verilebilece\u011fi gibi kiralanan\u0131n tesliminin ard\u0131ndan da kira s\u00f6zle\u015fmesine eklenebilir. Yine dava ya da icra takibi s\u0131ras\u0131nda kirac\u0131n\u0131n imzalad\u0131\u011f\u0131 bir tutana\u011fa ge\u00e7irilmesi yoluyla da tahliye taahh\u00fcd\u00fcnde bulunulabilir. Yarg\u0131tay bir karar\u0131nda \u201c\u2026daval\u0131 hen\u00fcz yarg\u0131lama devam ederken 01.03.2005 tarihi itibariyle evi bo\u015falt\u0131p davac\u0131ya teslim edece\u011fini tutana\u011fa ge\u00e7en beyan ve imzas\u0131 ile taahh\u00fct etmi\u015ftir. Yap\u0131lan bu taahh\u00fct h\u00e2kim \u00f6n\u00fcnde yap\u0131lan taahh\u00fct olarak ge\u00e7erlidir.\u201d h\u00fckm\u00fcne varm\u0131\u015ft\u0131r (Yarg\u0131tay 6. HD, 11.07.2005 T. 2005\/5933 E. 2005\/7384 K. say\u0131l\u0131 karar\u0131).<\/p>\n<p>Kiralanan\u0131n Aile Konutu Olmas\u0131<br \/>\nUygulamada s\u0131kl\u0131kla kar\u015f\u0131la\u015f\u0131lan uyu\u015fmazl\u0131klardan olan kiralanan\u0131n aile konutu olarak kullan\u0131lmas\u0131 halinde, her iki e\u015fin de tahliye taahh\u00fcd\u00fcne r\u0131za g\u00f6stermesi gerekmektedir.<\/p>\n<p>Nitekim Yarg\u0131tay bir karar\u0131nda \u201cMedeni Kanununun 194. madde h\u00fckm\u00fcne g\u00f6re e\u015flerden biri di\u011fer e\u015fin a\u00e7\u0131k r\u0131zas\u0131 bulunmad\u0131k\u00e7a aile konutuna ili\u015fkin kira s\u00f6zle\u015fmesini feshedemez, aile konutunu devredemez, aile konutu haklar\u0131n\u0131 s\u0131n\u0131rlayamaz. \u0130cra Mahkemesince bor\u00e7lu kocan\u0131n tahliye taahh\u00fcd\u00fc vermesi nedeniyle yap\u0131lan tahliyeye ili\u015fkin takipte m\u00fc\u015fteki kar\u0131n\u0131n yukar\u0131da a\u00e7\u0131klanan madde h\u00fckm\u00fc gere\u011fince 3. ki\u015fi say\u0131lmayaca\u011f\u0131ndan\u2026\u201d \u015feklinde h\u00fck\u00fcm kurmu\u015ftur (Yarg\u0131tay 12. HD, 24.05.2004 T. 2004\/8225 E. 2004\/5908 K. say\u0131l\u0131 karar\u0131).<\/p>\n<p>Beyaza \u0130mza<br \/>\nBeyaza imza, bo\u015f k\u00e2\u011f\u0131d\u0131n imzalanmas\u0131 hallerine verilen isimdir. Kirac\u0131n\u0131n beyaza imza suretiyle verdi\u011fi ve daha sonra kiraya veren taraf\u0131ndan doldurularak haz\u0131rlanan tahliye taahh\u00fcd\u00fc Yarg\u0131tay\u2019\u0131n yerle\u015fik i\u00e7tihatlar\u0131na g\u00f6re ge\u00e7erli say\u0131lmaktad\u0131r. Yarg\u0131tay bir karar\u0131nda \u201c\u2026at\u0131lan imza, imza sahibi kirac\u0131y\u0131 ba\u011flayaca\u011f\u0131ndan tahliye taahh\u00fcd\u00fcn\u00fc i\u00e7eren bu belgedeki tarihlerin sonradan dolduruldu\u011fu yolundaki itiraza itibar edilemez. Taahh\u00fctnamedeki tanzim tarihinin bo\u015f olarak b\u0131rak\u0131l\u0131p davac\u0131ya verildi\u011finin kabul edilmesi halinde dahi daval\u0131 kirac\u0131 bu \u015fekildeki davran\u0131\u015f\u0131n\u0131n sonucuna katlanmak zorundad\u0131r. Tanzim tarihinin sonradan doldurulmu\u015f olmas\u0131n\u0131n sonuca etkisi bulunamamaktad\u0131r.\u201d h\u00fckm\u00fcne vararak kirac\u0131n\u0131n beyaza imzas\u0131n\u0131n sonucuna katlanmak zorunda oldu\u011funu ifade etmi\u015ftir (Yarg\u0131tay 6. HD, 11.03.2008 T. 2008\/11 E. 2008\/2784 K. say\u0131l\u0131 karar\u0131).<\/p>\n<p>b. Tahliye Taahh\u00fcd\u00fcn\u00fcn Yaz\u0131l\u0131 Olmas\u0131<\/p>\n<p>TBK m. 352\/1\u2019de tahliye taahh\u00fcd\u00fcn\u00fcn unsurlar\u0131 aras\u0131nda yaz\u0131l\u0131l\u0131k \u015fart\u0131 say\u0131lm\u0131\u015f olup s\u00f6zl\u00fc tahliye taahh\u00fcd\u00fcne dayan\u0131larak kirac\u0131n\u0131n tahliyesi talep edilemez. Yaz\u0131l\u0131l\u0131k \u015fart\u0131 bir ge\u00e7erlilik \u015fart\u0131 olup taahh\u00fcd\u00fcn adi yaz\u0131l\u0131 \u015fekille verilmi\u015f olmas\u0131 yeterlidir.<\/p>\n<p>Ancak 04.12.1957 tarihli Yarg\u0131tay \u0130\u00e7tihad\u0131 Birle\u015ftirme Karar\u0131 uyar\u0131nca, kirac\u0131n\u0131n adi yaz\u0131l\u0131 \u015fekille verilmi\u015f taahh\u00fctteki imzay\u0131 veya tarihi ink\u00e2r etmesi halinde, icra mahkemelerinde itiraz\u0131n kald\u0131r\u0131lmas\u0131 davas\u0131 a\u00e7\u0131lamayacak olup genel mahkemelerde tahliye davas\u0131 a\u00e7\u0131lacakt\u0131r.<\/p>\n<p>c. Tahliye Tarihinin Belirli Olmas\u0131<\/p>\n<p>Tahliye taahh\u00fcd\u00fcn\u00fc d\u00fczenleyen TBK m. 352\/1\u2019de taahh\u00fcd\u00fcn belli bir tarihte verilmi\u015f olmas\u0131 unsurlar aras\u0131nda say\u0131lm\u0131\u015ft\u0131r. Buna g\u00f6re taahh\u00fcd\u00fcn verildi\u011fi anda tahliye tarihi belirlenmemi\u015f taahh\u00fctler ge\u00e7ersiz say\u0131lacakt\u0131r. Tarihin g\u00fcn, ay, y\u0131l olarak belirlenmesi yeterlidir.[3]<\/p>\n<p>d. Tahliye Taahh\u00fcd\u00fcn\u00fcn Kiralanan\u0131n Teslim Tarihinden Sonra Verilmesi<\/p>\n<p>6570 say\u0131l\u0131 Kanun d\u00f6neminde kiralanan ta\u015f\u0131nmaz\u0131n teslimine dek kirac\u0131n\u0131n serbest iradesini korumak amac\u0131yla geli\u015ftirilen Yarg\u0131tay \u0130\u00e7tihad\u0131 Birle\u015ftirme Karar\u0131, 6098 say\u0131l\u0131 Kanun d\u00f6neminde a\u00e7\u0131k\u00e7a kanuni d\u00fczenleme haline gelmi\u015ftir. TBK m.352\/1 uyar\u0131nca tahliye taahh\u00fcd\u00fc, kiralanan ta\u015f\u0131nmaz\u0131n tesliminden sonra verilecek olup teslimden \u00f6nce veya teslimle birlikte verilen tahliye taahh\u00fctleri ge\u00e7ersiz say\u0131lacakt\u0131r.<\/p>\n<p>Eski Malik Taraf\u0131ndan Al\u0131nan Tahliye Taahh\u00fcd\u00fcn\u00fcn Yeni Malik Bak\u0131m\u0131ndan Ge\u00e7erlili\u011fi<br \/>\nKiralanan ta\u015f\u0131nmaz\u0131n devri halinde yeni malik, eski malik d\u00f6neminde verilmi\u015f tahliye taahh\u00fcd\u00fcne dayanarak dava a\u00e7abilir ya da icra takibi ba\u015flatabilir. Zira, yeni malik ta\u015f\u0131nmaz\u0131n devri ile birlikte kira ili\u015fkisini de devrald\u0131\u011f\u0131ndan ona ba\u011fl\u0131 olarak yap\u0131lan di\u011fer s\u00f6zle\u015fme ve taahh\u00fctlerin da taraf\u0131 olacakt\u0131r. Kira s\u00f6zle\u015fmesinin tapuya \u015ferh edilmesi, yeni malikin taahh\u00fcde dayanmas\u0131n\u0131 engelleyemeyecektir. \u00c7\u00fcnk\u00fc kirac\u0131n\u0131n tahliye taahh\u00fcd\u00fcnde bulunmas\u0131, kira s\u00f6zle\u015fmesine ba\u011fl\u0131 olarak sonraki maliklere kar\u015f\u0131 da ileri s\u00fcrebilece\u011fi haklar\u0131ndan feragat etti\u011fi anlam\u0131na gelmektedir.[4]<\/p>\n<p>Tahliye Taahh\u00fcd\u00fcn\u00fcn Sonu\u00e7lar\u0131<br \/>\nTahliye taahh\u00fcd\u00fcne dayanarak kira ili\u015fkisini sona erdirmek isteyen kiraya veren, tahliye taahh\u00fcd\u00fcnde yer alan tarihten itibaren bir ay i\u00e7erisinde dava a\u00e7abilir ya da icra takibi ba\u015flatabilir. Kiraya verenin icra takibi ba\u015flatmas\u0131 halinde, kirac\u0131ya tahliye emri g\u00f6nderilerek ta\u015f\u0131nmaz\u0131n terki i\u00e7in s\u00fcre verilir.
